Wedding & Portrait Photography Terms & Conditions
The terms listed below shall be deemed as a contract between you “The Client” and Aria Photography known hereafter as “The Photographer” and no variation or modification of this contract shall be effective, unless agreed by Aria Photography in writing.
1. Booking Fee and payments
A non-refundable, non-transferable, booking fee of 50% secures the services of the Photographer.
All prices quoted to the Client apply only to the original job description and specifications given to the Photographer by the Client. The Photographer reserves the right to make additional charges should these descriptions or specifications differ or change before, during or after the assignment.
Events that are postponed (by the client) to a later date will be subject to re-booking providing the photographer can re-schedule for the new date and time.
The remaining balance will be due 90 days before the wedding day.
The photographer is the only authorised and official photographer for your wedding day
b) Sittings for Portraiture
The remaining balance of any fees due are to be paid on, or before the date of the sitting.
Additional goods ordered must be paid for in full at the time of ordering.
Some digital images may be adjusted for skin blemishes, exposure, brightness, contrast, sharpness, etc, similar to the film processing & print carried out in the darkroom, if traditional film photography has been requested. The Photographer's judgement regarding these corrections and the number of images put forward to the client for preview shall be deemed correct.
This work is carried out within the costing of The Photographer agreed fees.
3. Copyright and Ownership
In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all images created by the Photographer remain the property of the Photographer. All photographic reprints, digital duplications or copies of any type made from images created by the Photographer shall only be carried out by the Photographer. The Photographer reserves the right to charge an additional fee if the photographs are used for purposes other than that shown on the Photographers invoice.
The Photographer reserves the right to make reproductions of images created during assignments for marketing and competition.
4. License, Coverage and Reproduction
Photographs taken during the course of the event will be at the discretion of the photographer and shall be granted artistic license in relation to the poses photographed and the locations used. Every effort will be made to comply with the clients requirements.
For bookings involving certain venues the photographer's movements are sometimes restricted by the officials in charge which may cause an obstructed view. Also due to a variety of lighting conditions and the limitations in contrast with camera sensors, some colours may be altered throughout a set of photographs. The photographer cannot accept responsibility for any of the above.
5. Force Majeure
The due performance of this contract is subject to alteration or cancellation by the photographer owing to unforeseen circumstances caused beyond his control.
In the unlikely event of the Photographer being unable to attend your wedding/sitting, we reserve the right to appoint an alternative photographer. In the unlikely event of a total photographic failure or cancellation of this contract by the photographer or in any other circumstances the liability shall be limited to the total value of the contract excluding indirect or consequential loss. 6. Personal Accident
Any directions issued to clients, their guests or employees during a photographic session are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic assignment.
7. Liability Insurance
“The Client” is responsible for the Public Liability Insurance, which covers all aspects of the photographic work. This insurance must be available to inspect by “The Photographer” upon request.
Any complaints should be raised by “The Client” with The Photographer in writing within 28 days of receipt of the images.
The Client” may cancel the contract at any time by giving written notice to “The Photographer”. A cancellation fee of 50% of the total cost shall apply if cancelled 90 days prior to assignment taking place. Should cancellation of the contract occur after this period or expenses incurred in relation to the contract, full costs will be charged to “The Client” and will be payable in full.
10. specific requirements
Any specific requirements must be agreed at the time of booking. “The Photographer” will make every effort to comply with these request however it may not be possible to achieve the desired images within a limited timescale.
11. Weather conditions
In order to operate safely and within the limits of the equipment, from time to time weather conditions, high winds, lightening and rain, may preclude photography from taking place satisfactory. In such circumstances “The Photographer” cannot be held responsible will accept no liability for any failure due to the prevailing weather conditions. Any specific requirements regarding weather conditions for your images, e.g., sunshine, must be agreed at the time of order. “The Photographer” will make every effort to comply with these request however it may not be possible to achieve the desired images within a limited timescale.
